Terms of Use

This Brenstew Pty Ltd site, (the “site”) is a shopping website where you can browse, select and order products from Brenstew Pty Limited (ABN 80 464 957 961) (“Brenstew”, “us” or “we”).

Your access to and use of the site, including your order of products through the site, is subject to these terms and conditions, the Privacy Policy and any other laws or regulations which apply to this website.

You agree to comply with all relevant laws relating to your use of the site and your placement of any order through the site. You agree to be bound by and comply with the terms and conditions that apply to the use of the site, the shopping terms and conditions. If you do not accept these Terms and Conditions, you must refrain from using this website.

Shopping Terms and Conditions

This agreement is a contract between the customer (“you”) and Brenstew Pty Ltd ABN 80 464 957 961 (“Brenstew”), 329 Peel Street, Tamworth NSW 2340.

Please read the following terms and conditions carefully before placing your order with Brenstew. By completing and submitting the customer order form online and using the Brenstew service, you acknowledge that you have read and agree with the terms and conditions outlined below.

Brenstew reserves the right at all times to make changes to the Brenstew Terms and Conditions, stock offers, bonuses and rewards at its sole discretion without prior notice.

1. Definitions

The following apply to these Terms and Conditions:

Agreement means an agreement between you and Brenstew to supply Goods.

Delivery Address means the address to which the Goods are to be delivered as stated on the Order.

Goods means Goods described in an Order

Order means an order by you to purchase Goods from Brenstew.

Personal Information includes, but not limited to your name, Delivery Address and payment details.

2. Price of Goods and payment

All prices quoted are in Australian Dollars, and include GST. Prices shown do not include delivery and gift wrapping. You agree to pay the delivery and handling fee in respect to each product ordered and all applicable taxes in that regard.

3. Variation

Brenstew reserves the right to change or alter prices of products without notice. The price applicable shall be the price applicable on the date the Goods are confirmed as ordered. Prices for products shown on the website may vary from prices offered or charged in a Brenstew operaated store for equivalent products

4. Method of Payment

You may use your Visa Card, MasterCard, Visa, American Express. Brenstew does not accept cheque or cash for payments for Goods. Payment must be cleared before the Goods are dispatched.

5. Delivery

A separate delivery fee applies for each order.

You may nominate a delivery week however Brenstew is unable to ensure or guarantee delivery on a nominated day.

6. Delivery Charges

For deliveries in Australia a $8.00 delivery charge applies to each order to be delivered.

7. Risk & Title

Risk and title in the Goods passes to you upon delivery of the Goods to your nominated Delivery Address.

8. Delivery Requirements

Brenstew does not make Goods available for collection. Goods cannot be delivered to a P.O Box address.

A person must be at the Delivery Address to accept the goods on delivery. Anyone at the Delivery Address who receives the Goods shall be presumed to be authorised to receive the Goods on your behalf. If there is no-one at the Delivery Address or no-one of the appropriate age to receive the Goods (or the person is unable or unwilling to provide appropriate proof of age), a calling card will be left for you to collect the Goods from the post office.

Brenstew will not accept responsibility for late delivery or non-delivery due to incomplete or incorrect details provided.

9. Stock and Product Availability

All Goods featured on this site have been included in good faith on the basis that the Goods as described will be available at the time of the sale. Please note that customer orders are not available should an item not be available.

Brenstew will use its best endeavours to ensure that all Goods ordered by you are supplied to you. If the Goods ordered by you are not readily available in stock, whenever possible Brenstew will offer you a comparable product of equal or greater value.

10. Cancellations

Orders may only be cancelled online within 24 hours from the time of placing the order, after which the Goods will be delivered.

11. Returns

Exchanges and returns will be processed in accordance with the current Brenstew Returns Policy.

Gift Cards cannot be exchanged for another denomination or tender (ie cash). Gift Cards cannot be refunded or returned, unless required by law.

Please note that delivery fees and handling fees are non refundable, unless required by law.

12. Privacy and Security

13. Promotions and Discounts.

Brenstew at its discretion, may honour promotions, discounts or offers currently available instore, however all advertised items are available only while stocks last unless otherwise stated in the advertisement.

14. Applicable Laws

The laws of New South Wales, Australia govern this agreement.
